A nation’s culture may reside in the hearts and souls of its people, as Mahatma Gandhi once stated, yet surely, it takes its most tangible form in creative expressions of masonry and ingenuity that survive the twists and turns of history.

Consider Taj Mahal in India; the ancient ruins of Persepolis in Iran; the Great Pyramids of Giza in Egypt; the Great Wall of China; Ephesus in current day Turkey; the Acropolis of Athens, or Timbuktu in Mali, to name only a handful of examples – all these World Heritage sites immediately trigger our senses and arouse our curiosity about the past. How plain would our existence be and how arid our imagination without these magnificent marvels embellishing our contemporary world and enriching the world of tomorrow.

Cultural heritage is the mirror of humanity

Architecture, literature and the arts – these are all profound human expressions in the physical world that define who we are, reflect our zeitgeist, and render timeless our humanity and the experiences of our epoch in an otherwise transient human existence.

They enable us to pass on to our descendants who we were, what we stood for, and what we achieved. They narrate our ordeals and triumphs, and bestow upon future generations hard earned wisdom acquired through trial and error.

They educate, inspire and stimulate innovation. They provide a basis from which to learn our past so as to build our future.  And last but not least, they form, in many ways, our foundational building blocks - our constitution; they strengthen our identity and serve as solid evidence of the continuity of the human story and the richness of our diversity.

“Cultural heritage is [indeed] the mirror of humanity” and the repository of the human experience throughout the ages.

It should come as no surprise, then, that deliberate attacks on such a profoundly important manifestation of our identity is increasingly seen as repugnant to our cultural ethos in this new century.

Deliberate attacks against cultural property: an increasingly prevalent and worrying trend

Be that as it may, seemingly aloof to the destructive impact of WWII, in the last decades alone, we have continued to witness lawless wars and extremist ideologies that have caused untold suffering and destruction, accompanied by the plunder and defacing of antiquities.

Deliberate attacks against the old Mostar bridge in what is today Bosnia and Herzegovina; the destructive siege of the Old Town of Dubrovnik (1991); the defaced and mutilated Buddhas of Bamiyan in central Afghanistan (2001); the desecration of religious sites and historic monuments in Timbuktu; and, most recently, the ancient historical sites in Mosul, Iraq (2014) and Palmyra in Syria (2015) all point to a worrying trend.

In short, in our times, wanton intentional attacks against cultural property occur with alarming frequency and continue to devastate not only the communities directly affected by such immeasurable loss but also the whole of humanity.

As conflicts rage on in many parts of the globe, further damage to cultural property remains, alas, a real possibility.  In Libya, for instance, continued political instability and the persistent security vacuum make the country’s rich ancient sites exceedingly vulnerable.

A responsibility to protect our common heritage

We have a responsibility to protect such invaluable worldly possessions of our common heritage. We must use all means at our disposal to counter the scourge of deliberate destruction of cultural property. To this end, we must strengthen our capabilities and cultivate the necessary assets. A multifaceted and multi-disciplined approach is required to confront this challenge.

When the circumstances so dictate, a legally sanctioned military response in strict conformity with jus in bello may be warranted to thwart the destruction of cultural property. Education and training of relevant stakeholders, including military personnel engaged in combat operations, as a tool of prevention is also in much need. The pioneering work of UNESCO in this regard is commendable and must be fully supported (Director General of UNESCO, Honorable Irina Bokova, also contributed an article to this Arguendo roundtable).

Punishment and deterrence through the law is another important component of confronting the scourge of intentional destruction of cultural property. Fortunately, the necessary legal instruments and framework are already in place.

From the 1907 Hague Regulations; the 1935 Roerich Pact; the 1954 Hague Convention for the Protection of Cultural Property in the Event of Armed Conflict and its Protocols (1954 and 1999); the 1972 UNESCO Convention Concerning the Protection of the World Cultural and Natural Heritage; to the UNESCO Declaration on Intentional Destruction of Cultural Heritage, adopted in October 2003, amongst others, are all aimed at stressing the importance of protecting cultural heritage and creating obligations to safeguard cultural property against armed attack.

While The Hague Convention currently benefits from 127 member states, and Chapter Four of its Second Protocol defines condition under which individual criminal responsibility may be imposed, prosecutions at the national level are a rarity at best and often non-existent. The real challenge therefore lies largely in lack of effective and consistent enforcement.

This impunity gap must be addressed.

The role of the ICC

With the entry into force of the Rome Statute on 17 July 2002, and the creation of the International Criminal Court (“ICC” or the “Court”), for the first time the world has been equipped with an independent international judicial mechanism with the mandate to try those most responsible for the wanton destruction of cultural property during armed conflict.

Indeed, under article 8 of the Court’s founding treaty, intentional attacks against buildings dedicated to, inter alia, religion or art, or historic monuments constitute a war crime. Depending on the circumstances, such acts may also constitute persecution under article 7 as a crime against humanity. With 124 States Parties and growing, the ICC in conformity with its mandate can make a significant contribution as part of a comprehensive response to the preservation and protection of cultural property.  The Court disposes of all the requisite legal arsenal to effectively play this crucial role.

This is not a theoretical construct.

Long before the destruction of historical sites in Syria and Iraq captured the world’s attention, the Court’s Prosecutor, Mrs Fatou Bensouda, stressed the need to curb deliberate destruction of protected cultural property within the Court’s legal framework. The Office’s work with respect to Mali is a case in point.

As is now widely reported, in September 2015, based on the materials adduced by the Prosecution, the Court’s Judges issued a warrant of arrest against Mr Ahmad Al Faqi Al Mahdi, a member of Ansar Eddine associated with Al Qaeda in the Islamic Maghreb.

In March of this year, the Court’s Pre-Trial Chamber found that the evidence presented by the Prosecutor was sufficient to establish substantial grounds to believe the suspect is criminally responsible for the war crime of intentionally directing attacks against a number of historic monuments and buildings dedicated to religion in Timbuktu in June and July of 2012.

As outlined in the Prosecutor’s opening statement at the confirmation of charges hearing, “[i]n the 15th and 16th centuries, Timbuktu – now designated UNESCO World Heritage site - became one of the intellectual and spiritual capitals of Africa. It played an essential role in the expansion of Islam; it was the cradle of education, a place of enlightenment for generations of students, attracting many scholars.”  The destruction of Timbuktu, the Prosecutor added, “constitutes the annihilation of structures that had survived the ravages of time and which stood as testimony to Timbuktu’s glorious past and important place in history and to its people over generations.”

The Court’s judges confirmed the charges and committed Mr Al-Mahdi to trial. On the 22nd of August 2016, his trial is scheduled to commence.

What is noteworthy is that the suspect in this case has already expressed his intention to plead guilty. This is significant, not the least because it has the potential to expedite the judicial process and ultimately trigger reparations proceedings, making justice more tangible for the victims, and paving the way for reconciliation.

This case is also significant for a number of other reasons.  It is the first case before the Court on the sole charges of deliberate destruction of buildings dedicated to religion and historic monuments.  By that fact alone, it stands firm as an important precedent. Second, it demonstrates the Office of the Prosecutor’s commitment to investigating and prosecuting these crimes, and by so doing, highlighting their gravity.  Similarly, the effective investigation and prosecution of such crimes can have a deterrent impact.  Certainly, the absence of accountability does little to advance the cause of prevention.

It is also important to point out that, in line with the Prosecutor’s commitment to curb such criminality, the Office will develop a comprehensive policy paper on protected cultural property under the Rome Statute.

The work on this policy will commence in the last quarter of 2016 following the finalization and official launch of the Office’s Children’s Policy in the margins of the upcoming Assembly of States Parties.  The Office will be working closely with UNESCO and other stakeholders in the development and consultation of this endeavour.

As with past policies, it is the Prosecutor’s hope that this new policy will provide further transparency and guidance to the Office in the systematic investigation and prosecution of such crimes, and that it will also serve as a helpful reference document to assist prosecutions at the national level.

Need for concerted and committed action

The Court is a crucially important judicial mechanism that, through its work, can highlight the severity of these crimes, and by holding perpetrators accountable, deter the commission of similar crimes in the future.  In other words, the ICC is critical to the fight against impunity for the destruction of cultural heritage in this new century.  In order for the Court to have more of an impact, universal jurisdiction is of course crucial.  More states are encouraged to ratify the Rome Statute to join the ICC family, and by so doing, benefit from the legal protections it provides.

The ICC is, of course, not a panacea.

It must also be stated that the primacy of jurisdiction to investigate and prosecute these crimes rests in the first instance with the national authorities.  States must uphold these obligations and demonstrate their commitment by ratifying relevant international legal instruments, and by adopting and applying implementing legislation; in effect, equipping themselves with the legal tools to effectively pursue and deter these crimes through national prosecutions.

To borrow from the words of Prosecutor Bensouda at the opening of the case of the Prosecution v. Ahmad Al Faqi Al Mahdi: “history itself, whose physical embodiment is at peril through such attacks, will not be generous to our failure to care or act decisively.”

The scourge of deliberate attacks and destruction of cultural property must be stopped through concerted and committed action.   There is no hierarchy in mass atrocities.  These grave crimes must be pursued with the same vigour as other atrocity crimes.

Without the traces of our past, our path ahead is less certain. Without those critical bonds and the awareness that cultural heritage cultivates amongst peoples and nations of the world, the ends of sustainable peace and conflict prevention will become even more precarious and out of reach.

To safeguard the hallmarks of humanity, we must protect cultural heritage. To do so effectively, surely, we must employ the vector of the law as a punitive and preventative instrument of dispensing justice. At the Office of the Prosecutor of the ICC, we will continue to play our part.

Sam Sasan Shoamanesh

Sam Sasan Shoamanesh is the Chef de Cabinet to the Prosecutor of the International Criminal Court (“ICC”), having assumed this post in September 2013. As an attorney specialized in international law, he has served the ICC since 2005 in different capacities. He has also worked for a number of other international judicial bodies, including the UN International Criminal Tribunal for the former Yugoslavia and the International Court of Justice. In 2011, he initiated and co-organized the first regional diplomatic conference on the ICC in the Middle East, hosted in Doha, in cooperation with the League of Arab States and the government of Qatar. He also serves as the Vice-President of the Institute for 21st Century Questions and Managing Editor of Global Brief magazine.

Shoamanesh has held several international consultancies and has published widely, with a particular focus on the Middle East. In addition to book chapters, his writings have appeared in Al Jazeera, Al-Monitor, An-Nahar (Arabic), the Harvard International Review, The Globe & Mail and the Huffington Post.

Shoamanesh is an inaugural member of the Council of Advisers to the Global Institute for the Prevention of Aggression. He is the recipient of the 2012 Arthur C. Helton Fellowship, awarded by the American Society of International Law, as well as the 2012 l’Ordre du mérite, the highest distinction awarded to alumni by the Civil Law Section of the Faculty of Law, University of Ottawa.

He holds degrees in political science from York University, an LLB (Common Law) and LLL (Civil Law) from the Faculty of Law, University of Ottawa, as well as a Master of the Science of Law (JSM) from Stanford Law School. He has also been trained in international law, diplomacy and negotiations at, amongst others, the École nationale d’administration (Paris), Harvard Law School, the University of Oxford, the Jordan Institute of Diplomacy and The Hague Academy of International Law.

Gilles Dutertre

From 1997 to 2002, Gilles Dutertre served as a prosecution trial lawyer and, subsequently, as a sentence enforcement judge in France. From 2002 to 2005, he was posted to the Human Rights department of the Legal Affairs Division of the Ministry of Foreign Affairs in Paris, where he served as co-agent of the French Government before the European Court of Human Rights. During this time, he also took part in various multilateral negotiations, including for the establishment of the International Convention for the Protection of All Persons from Enforced Disappearance. He was also a member of the Steering Committee for Human Rights of the Council of Europe. He is the author of Key case-law extracts - European Court of Human Rights. From 2005 to 2008, Gilles Dutertre practised as a Trial Attorney at the International Criminal Tribunal for the former Yugoslavia. He was then recruited by the Office of the Prosecutor of the International Criminal Court as a Trial Lawyer and later promoted to Senior Trial Lawyer. In this capacity, he is leading the case relating to the attack carried out on historic monuments and buildings dedicated to religion  in Timbuktu in 2012, currently pending before the ICC.
